1. Definitions

• “HauseNow”, “we”, “us”, “our” — the operator of this website and the matching service described here.
• “Service” — the website and the free service that connects homeowners with independent home improvement contractors.
• “User”, “you” — any person who accesses the site or submits a request through it.
• “Contractor” — an independent third-party business that may receive your request and contact you.

2. Acceptance of terms

By accessing the site or submitting a request, you agree to these terms and to our Privacy Policy. If you do not agree, do not use the service. You confirm that you are at least 18 years old and legally able to enter into these terms.

3. Service description

HauseNow is a free online service that connects homeowners with independent local contractors for roofing, window and bathroom projects. We are a matching and referral service.

4. Usage guidelines

4.1 General use

You agree to use the service only for lawful purposes and to refrain from:

• Submitting false, misleading or fraudulent information
• Submitting requests on behalf of someone who has not asked you to
• Interfering with the operation or security of the site
• Using automated systems to scrape, harvest or submit data
• Reproducing or redistributing site content without permission

4.2 Information accuracy

You agree to provide accurate and complete information when using the service, including on any partner site you continue to. Quotes are only as good as the information they are based on.

5. User responsibilities

5.1 Contractor verification

You are responsible for verifying, before hiring anyone, that a contractor holds valid licensing and insurance for the work and jurisdiction in question, checking references and reviews, confirming scope and price in writing, and satisfying yourself that the contractor is a fit for your project. Our screening does not replace your own due diligence.

5.2 Contracts and payments

All contracts, payments, schedules, warranties and disputes are between you and the contractor. We are not involved in and take no responsibility for the terms, performance or payment of any such agreement.

6. Disclaimers and limitation of liability

6.1 “As is” basis

The service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied.

6.2 No warranty

To the fullest extent permitted by law, HauseNow disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant the quality, timeliness, legality, safety or outcome of any work performed by a contractor, nor that you will receive a quote, that any quote will be accurate, or that the service will be uninterrupted or error-free.

6.3 Limitation of liability

To the fullest extent permitted by law, HauseNow and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or connected with your use of the service or with any contractor's acts or omissions — whether based in contract, tort, strict liability or any other theory, and even if we have been advised of the possibility of such damages. Where liability cannot be excluded, our total aggregate liability is limited to one hundred US dollars (US $100.00).

7. Indemnification

You agree to indemnify, defend and hold harmless HauseNow and its officers, employees and agents from any claim, demand, loss, liability or expense (including reasonable legal fees) arising from your use of the service, your breach of these terms, your violation of any law or third-party right, or any dispute between you and a contractor.

8. Privacy and data protection

Your use of the service is also governed by our Privacy Policy, which explains what we collect and what happens when you continue to our partner's site. California residents should also read the California Privacy Notice.

9. Third-party links and services

The site may link to third-party websites and services. We do not control them, do not endorse them, and are not responsible for their content, products, practices or policies. Access them at your own risk and under their terms.

10. Intellectual property

The site and its content — including text, graphics, logos, layout, design and software — are the property of HauseNow or its licensors and are protected by intellectual property law. The HauseNow name and logo are our trademarks. You may not copy, modify, distribute, publicly display or create derivative works from the site without our prior written permission.

11. Modifications to terms

We may modify these terms at any time. Changes take effect when posted, and the “last updated” date will be revised. Continued use of the service after a change constitutes acceptance of the updated terms.

12. Termination

We may suspend or terminate your access to the service at any time, with or without notice, for conduct that we believe breaches these terms or is otherwise harmful to other users, contractors or us. Sections that by their nature should survive termination — including disclaimers, limitation of liability and indemnification — will survive.

13. Governing law and disputes

These terms are governed by the laws of the United States and of the state in which HauseNow maintains its principal place of business, without regard to conflict-of-law rules.

Except where a dispute qualifies for small claims court, you and HauseNow agree to resolve any dispute arising out of or relating to these terms or the service through binding, individual arbitration administered under the rules of the American Arbitration Association, rather than in court. You and HauseNow each waive the right to a jury trial and to participate in a class action, class arbitration or representative action. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a class or representative proceeding. If this class-action waiver is found unenforceable as to a given dispute, that dispute may proceed only in the state or federal courts located in HauseNow's home jurisdiction described above, and you consent to their personal jurisdiction and venue; the remainder of this arbitration agreement stays in effect for all other disputes.

14. Severability

If any provision of these terms is found invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary and the remaining provisions will stay in full force.

15. Entire agreement

These terms, together with the Privacy Policy and the California Privacy Notice, constitute the entire agreement between you and HauseNow regarding the service, and supersede any prior agreements on the subject.
